Responsibilities
The Butte-Silver Bow Law Enforcement Department maintains control and chain of custody of all property brought in by officers. Property is secured and retained in the evidence room until it is determined the property can be released to its rightful owner, or disposed of in the case of illegal or contraband items.

Evidence Release Policy
Evidence can be released Monday through Friday between the hours of 9 a.m. and 4 p.m.
A signed release form must be obtained from the Butte-Silver Bow County Attorney's Office listing the property to be released and the name of the individual receiving the property. The form must be presented to the evidence technician at the Butte-Silver Bow Law Enforcement Department for retrieval of property.
You must present a picture I.D. at the time you come in to retrieve your property.
If you are unable to pick up your property and designate another individual to pick up your property, please present the authorization to pick up property form, signed and notarized. The individual picking up your property must also present a picture I.D.
Firearms Release Policy
In order to retrieve firearms, the owner must first obtain a signed release form from the Butte-Silver Bow County Attorney's Office. The form must be presented to the evidence technician at the Butte-Silver Bow Law Enforcement Department, along with a picture I.D. If you have proof of ownership of the firearm, please present that also.
A background check will be run on the individual to determine if there is anything in the background to prohibit ownership of a firearm. It takes approximately a half hour to run the background check. Please allow yourself enough time. Ammunition is not released back at the same time as the firearm. You may come back at a later time and retrieve your ammunition.
If it is determined by the background check that an individual is prohibited from owning a firearm, they may transfer ownership of said firearm to another individual. Please present the firearms ownership transfer authorization form, signed and notarized. The individual obtaining ownership of the firearm will also have to present a picture I.D. and be subject to a background check.
Property Authorized for Release
Owners of property that is authorized for release by the County Attorney's Office and the investigative officer will be notified by mail that they may come into the Butte-Silver Bow Law Enforcement Department to retrieve their property. They must bring the letter with them, along with a picture I.D. If property is not picked up within 10 working days of receipt of the letter, it will be assumed the owner is not interested in retrieving the property and it will be disposed of.
